Invitation-only Circle structure · fixed twelve-month term · no automatic renewal

1. Scope and contracting party

These Circle Terms apply to the invitation-only purchase of DIGNITAS, MAJESTAS or HEREDITAS for the relevant Circle Year. The contracting party is BARIÉN — Bülent Saritürk, Blockwinkel 108, 27251 Scholen, Germany. Circle correspondence: circle@barien.com. General enquiries: info@barien.com.

2. Consideration and admission

A request for consideration does not create membership, an entitlement to admission or an obligation on BARIÉN to issue an invitation. Admission is personal, non-transferable and limited by the capacity defined by BARIÉN for the relevant Circle Year.

A Circle relation is offered only after individual consideration. The relevant invitation gives access to the corresponding Circle Admission product.

3. Fixed term and further Circle Years

Each Circle relation is concluded for one fixed term of twelve months. The term and its commencement are stated in the contractual confirmation. The relation ends automatically at the end of that fixed term.

There is no automatic renewal and no automatic annual charge. Any further Circle Year requires a new invitation from the House, a new active purchase by the member and BARIÉN’s acceptance.

4. Contract formation and payment

The Circle Admission product identifies the applicable relation and annual fee. Before the paid order is submitted, the member receives the applicable contractual information, including the Circle relation, annual fee, fixed term and included benefits.

The member submits a binding offer by using the final payment control. The contract is concluded when BARIÉN confirms acceptance electronically. An automated order receipt is not acceptance unless it expressly states otherwise.

5. Circle relations and annual benefits

DIGNITAS includes one annual Circle Composition, the Annual Circle Discovery Set, private previews and considered access to additional Circle Compositions and selected Grande Créations where offered.

MAJESTAS includes the complete annual Circle trilogy, the Annual Circle Discovery Set, one private olfactory consultation and private dialogue with the House.

HEREDITAS includes the complete annual Circle trilogy, the Annual Circle Discovery Set, private olfactory dialogue, one Création Privée per Circle Year, Private Archive access and Legacy Nomination. HEREDITAS is offered only within a highly limited capacity.

6. Private correspondence and access

Circle correspondence, appointments, discovery, selection and fulfilment arrangements are handled directly by the House. Private Circle pages provide the shared written setting for the relation; they do not replace personal correspondence or create a promise that every Circle matter will be displayed online.

Access is personal. Members must not share account credentials or private Circle materials.

7. Circle Compositions and additional acquisitions

Three Circle Compositions are created for each Circle Year. Each is presented in an annual edition of 999 flacons. The first annual edition marks its Origin; each following annual edition continues as a Chapter.

DIGNITAS members may acquire the two Circle Compositions not included in their relation separately where offered and available. Priority or advance access to selected Grande Créations does not guarantee availability unless expressly stated in a binding offer.

8. Création Privée and Private Archive

One Création Privée is included per HEREDITAS Circle Year. It is developed through private dialogue, up to six olfactory interpretations, selection and one final refinement. Before a selected interpretation enters clearly personalised production, BARIÉN provides the required separate information and obtains any legally required confirmation.

A completed Création Privée may be preserved by the House as a Private Archive record. Private Archive Replenishment is arranged separately and is not included automatically in the annual fee.

9. Withdrawal and early performance

Where a statutory right of withdrawal applies, the member receives the applicable withdrawal information before the paid order is submitted. BARIÉN begins paid Circle service elements before the withdrawal period expires only where the member expressly requests early performance in a separate, optional declaration.

Beginning performance does not by itself remove a statutory withdrawal right. Any legally permissible payment following a valid withdrawal after requested early performance is limited to the proportionate value of services actually provided.

10. End of term and termination

The fixed term ends automatically without notice. Statutory rights to terminate earlier for cause remain unaffected. The online termination route required by applicable law is available independently of Circle access and does not create an additional contractual right to ordinary early termination during the fixed term.

11. Statutory rights, liability and law

Statutory rights relating to defective, incorrect or damaged goods and defective services remain unaffected.

BARIÉN has unlimited liability for intent and gross negligence, injury to life, body or health, liability under the German Product Liability Act, expressly assumed guarantees and any other liability that cannot legally be limited. For slight negligence, liability is limited to foreseeable damage typical for the contract where an essential contractual obligation is breached.

German law applies to the extent legally permissible. Mandatory consumer protection at the member’s habitual residence remains unaffected.

12. Data protection

Personal data processed in connection with consideration, admission, payment, correspondence, the Circle relation, Création Privée, Private Archive and Legacy Nomination is handled in accordance with the BARIÉN Privacy Policy.
