Terms & Conditions

Public product purchases

Scope and contracting party

These Terms & Conditions apply to purchases of BARIÉN products by consumers through the BARIÉN online store. The contracting party is BARIÉN — Bülent Saritürk, Blockwinkel 108, 27251 Scholen, Germany. Telephone: +49 4245 9190924. E-mail: concierge@barien.com.

A consumer is a natural person acting for purposes that are predominantly outside that person’s trade, business or profession.

Contract language, technical steps and contract record

The available contract languages are the languages offered in the relevant storefront. The customer selects products, reviews the bag, enters delivery and payment information, may correct entries before submission and submits a binding offer by using the final payment-obligation control.

BARIÉN stores the order and contract information in accordance with applicable law. The order details are transmitted electronically and, where an account is used, may remain accessible through the customer account. The customer should retain the contractual confirmation and applicable Terms & Conditions.

Products, presentation and annual editions

The essential characteristics, volume, edition information and price are shown on the relevant product page and in the final order summary. Product images may differ slightly in colour according to the display used; the contractual characteristics remain those stated in the product description.

Each public BARIÉN composition is presented in an annual edition of 999 flacons. The first annual edition carries the Origin designation; each subsequent annual edition carries the applicable Chapter designation. The individual flacon number is allocated from available stock and cannot be selected unless expressly offered.

Order and contract formation

By activating the final control that clearly indicates the obligation to pay, the customer submits a binding offer to purchase the products shown in the final order summary.

An automated acknowledgement confirms receipt but does not itself constitute acceptance unless expressly stated. The contract is concluded when BARIÉN expressly accepts the order, confirms dispatch or otherwise communicates acceptance on a durable medium.

BARIÉN may refuse an order where the product is unavailable, payment cannot be authorised, delivery to the selected destination is not supported, fraud or misuse is reasonably suspected, or another objective reason prevents performance. Any payment already received for a refused order will be reimbursed.

Prices, taxes and payment

Consumer prices include applicable VAT where legally required. The total price and every mandatory additional charge are shown before submission. The following payment methods are intended to be available, subject to the order, destination and customer context shown at Checkout: PayPal; credit and debit cards (Visa, Mastercard and American Express); Klarna, including invoice purchase, Pay Now / immediate payment and instalment payment; Apple Pay; Google Pay; Shop Pay; and bank transfer. Depending on the delivery country, additional country-specific payment methods offered through Shopify Payments (such as Bancontact, BLIK, eps, MB WAY, MobilePay or Bizum) may be available.

Payment may be processed immediately, authorised for later capture or remain pending depending on the selected method. BARIÉN is not required to dispatch until the payment status permits fulfilment under the configured payment logic.

Shipping and delivery

BARIÉN offers complimentary shipping within the European delivery markets activated in the store. The exact delivery destinations and available methods are shown during Checkout.

Estimated delivery information is not a binding delivery date unless expressly confirmed as such. Statutory consumer rights in the event of delayed or failed delivery remain unaffected.

Presentation, gifting and personalisation

Where offered, the customer may select a presentation for personal acquisition or as a gift and may provide a recipient name or personal message. The customer is responsible for ensuring that third-party information is accurate and may lawfully be supplied for the intended presentation or delivery.

Presentation choices do not restrict statutory rights relating to the fragrance unless the requirements of a specific statutory exception are met. A voluntary exchange may require the full-size composition to remain unopened; this does not limit mandatory statutory rights.

Right of withdrawal

Consumers generally have a statutory 14-day right of withdrawal for distance purchases. Conditions, procedure and consequences are set out in the separate Right of Withdrawal information. No exclusion is asserted merely because a fragrance has been opened unless a legally applicable exception has been clearly communicated and all statutory requirements are met.

Returns and Considered Exchange

For a statutory withdrawal, the customer bears the direct return cost where properly informed before contract conclusion. If a product is incorrect, damaged or defective, statutory rights apply and BARIÉN bears the necessary transport costs of the applicable remedy.

BARIÉN may approve a voluntary Considered Exchange to another composition. Where approved, return and replacement delivery may be arranged without an additional shipping charge, provided the full-size composition remains unopened and the applicable voluntary conditions are met. This service remains separate from statutory withdrawal and defect rights.

Statutory warranty

The statutory rights relating to defective goods apply without restriction. Any voluntary guarantee or additional service applies only where expressly stated and does not limit statutory rights.

Retention of title

Goods remain the property of BARIÉN until the purchase price has been paid in full.

Liability

BARIÉN has unlimited liability for intent and gross negligence; injury to life, body or health; liability under the German Product Liability Act; guarantees expressly assumed; and any other liability that cannot legally be limited.

For slight negligence, BARIÉN is liable only for breach of an essential contractual obligation whose fulfilment enables proper performance of the contract and on which the customer may normally rely. In that case, liability is limited to the foreseeable damage typical for the contract. Mandatory statutory liability remains unaffected.

Governing law and mandatory consumer protection

German law applies to the extent legally permissible. If the customer is a consumer habitually resident in another country, this choice does not deprive the customer of mandatory consumer-protection provisions that would apply in the absence of the choice.

Consumer dispute resolution

BARIÉN is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board unless a statutory obligation applies in an individual case.
